Acknowledges the importance of protecting individuals from discriminatory violence with hateful intent.
Applauding #711 efforts in its attempts at addressing reprehensible nature of hate crimes, yet ultimately believing that the current legislation under the targeted resolution under-performs its mandates while its overbearing nature consumes member states ability to handle these circumstances through self-interpretation;
Alarmed by the requirements of the targeted resolution,mandating member states to treat a hate-based motive as an aggravating factor, “to the same standard otherwise required to show guilt,” a clause that strictly imposes evidential burdens,risks the distortion of equitable administration of propriety and the overall degradation and even death of justice within abiding states whose judicial systems may not be equipped to reliably and consistently prove subjective motives, illustrating the unyielding an overbearing nature of the targeted resolution;
Nonplussed that #711 defines and subjects hate crimes based off of “arbitrary and reductive characteristics” alone, these terms are not only ill-defined and broad but the noxiousness nature of them risk inconsistent interpretations application/ usage within said jurisdictions, potentially criminalizing acts based on subjective or political charge rather than a universal recognized standard;
Concerned by the reservations of the target resolution and its potential for exploitability, enabling some governments or government entities that are abiding states to weaponize international law to silence legitimate dissidents or penalize speech under the assumption of hate crime legislation, #711 takes no action in upholding its envisioned standard; its broken foundation has allowed for inconsistencies, errors, failures, and abuse, further eroding the basic fundamentals recognized and natural to citizens;
Unconvinced that the target remains qualified in upholding and protecting the foundational principle shared as justice;
Hereby repeals GAR#711, “Prevention Of Hate Crime"
